Excerpt: ...first offense shall, upon conviction thereof, be fined not exceeding $100, and for each succeeding offense and conviction thereof shall be punished by a fine not exceeding $500, or by imprisonment not exceeding one year, or by both such fine and imprisonment, in the discretion of the court. Sec. 5. That all weighing and measuring devices hereafter manufactured or constructed for use in trade or commerce within the United States shall have stamped, engraved, etched, or otherwise marked thereon, in such manner as may be prescribed by the regulations authorized by section eight hereof, the name of the maker or manufacturer and the serial number of the approved type to which it belongs; and any person manufacturing or constructing any such device who shall fail to mark the same as provided for by this section shall be subject to a penalty of $50 for each such device which is not so marked: Provided, That whenever it shall appear to the satisfaction of the Bureau of Standards or the Secretary of Commerce that any type of weighing or measuring device is so small as to render it impracticable to mark it as required by this section, the said bureau shall furnish a certificate to that effect to any manufacturer or maker applying for the same, and such certificate shall exempt such manufacturer or maker from the requirements of this section. Sec. 6. That any person who shall fraudulently stamp, engrave, etch, or otherwise mark upon any weighing or measuring device the type of which has not been approved as required by this act any name, number, or other mark, with intent to have such device appear to be an approved type, shall be guilty of a misdemeanor, and shall, upon conviction thereof, be punished by a fine of not more than $500 or by imprisonment not...show more
