ACTION for the dishonour of a cheque for 100l., alleging as damage "in particular that one C. F. Dyson refused to deal with the plaintiff and to carry out the arrangements made for a partnership between him and the plaintiff, the plaintiff thereby losing the profits that would have accrued to him from the said partnership." The defendants paid into court 50l. The evidence of the plaintiff was that he was manager to a firm of stationers; that he agreed (not in writing) with C. F. Dyson, who was his brother, to enter into partnership with him for four years and a half, taking a third share in it, and paying 100l. at once, 250l. in January, and 250l. in February, or any part of the 500l. sooner, if required; that the plaintiff was to be a sleeping partner; that the profits of the business were at least 900l. per annum; that he drew the cheque in question and gave it to his brother on 4th January, 1882; that, on 5th January, he received from his brother a notice of dishonour, with a memorandum attached----" What is the meaning of this?" and terminating the agreement for the partnership; that the plaintiff went to the bank and found that his account had not been credited with a sum of 50l. deposited some months before; that he then told the manager the loss he had sustained by reason of the dishonour of the cheque; that his brother was not aware of his true pecuniary position; that the defendants' manager told him that the deposit of 50l. had been credited to the account of another customer of a similar name, the name on the deposit slip being...show more
