The only purposes of sec. 7 are to efiect amendments in sec. 15, so that either way I think the operative words govern the construction to be put on the word "apprentice" in sec. 15. Then comes a further question whether the agreement by which the complainant was bound in this case was " indentures of apprenticeship " within the meaning of sec. 7. It was not a deed under seal. The master was bound to employ for more than three years. It contained no express agreement by the master to instruct. The term " indentures of apprenticeship," so far as I can ascertain, has no specific legal significance, and will include a writing not under seal. The definition clause in the Act of 1900 describes an apprentice as " any person under twenty-one bound by indentures of apprenticeship and also any person under twenty-one employed under a written agreement signed by the employer on the one part and by such person and such person's parent or guardian on the other part under which such employer agrees to employ such person and such person agrees to work for such employer for not less than one year." The agreement in this case is such an agreement. The amending sec. 7 refers in terms only to apprentices under indentures, and only under indentures which bind the master to instruct. It is difficult to imagine why this new way of describing an apprenticeship document should be adopted. It seems to me probable that all the Legislature wished to provide for was bond fide employment as an apprentice for a term not less than three years, Whether this employment was under so-called ..".show more
