I do not recollect receiving any letter to that effect from Captain Dale in the month of July, but I remember Captain Dale requiring me to send him such an account every 24th. Q. 32. Did you send me any account in the month of July, in consequence of such request, and produce the original account? A. I did send Captain Dale an account on or about the 23d July. - Q. S3. By this account the balance due to me appears to be 4 2s. How much money was in fact due to me out of the - 40 at that that time, according to the account which I afterwards settled with you? A. The balance due to Captain Dale on the 24th July was 1 18s. Q. 34. In this account there are two sums, amounting together to 5 charged as paid to Serjeant Walton.--Whether Serjeant Walton had not, in fact, applied part of this money to his own use, and whether you did not lately obtain part of it back from him? A. He did apply it to his own use, and I have lately got it-back again. Q. 35. Whether this is not the account referred to m my letter of the 25th July, already before the court? A. It is. Q. 36.
