And for a second cause of action the Plaintiif's complain and allege that between the 10th day of June, 1867, and the 28th day of November, 1867, the plaintiffs, at the city of New York, sold and delivered to the said defendants and to the said James M. Plumb and Leonard D. Atwater, at their request, and the said defendants and the said James M. Plumb and Leonard D. Atwater purchased and received from the said plaintifis, goods, wares, and merchandise of the value and to the amount of two hundred and forty eight dollars. EIGHTH. That there is due and owing to the plaintiffs from the defendants the sum of two hundred and forty eight dollars on account of said sale as aforesaid with interest thereon as hereinafter de manded, which has not been paid, nor any part thereof. 13 VVherefore the plaintiffs demanded judg-ment against the defendants for the sum of three thousand two hundred and twen-ty three dollars and eighty cents, with in-terest on $2, 975,80 thereof from the 27th day of May, 1868; and interest on $248, from the 1st day of January, 1868, besides the costs of this action._ JOHN TODD, Plaintiff' s Attorney.
