Excerpt: ...operation of said ferry and carrying on said ferry and transfer business with, said property the interest every three months to said first party on the claim which said first party holds against said second party for twenty thousand dollars, due March 1st, 1878, which said claim arises from the contract to sell said property herein leased, made this day between said parties, by which said first party agrees to sell and deliver said property to second party on March 1, 1878, on the payment of said twenty thousand dollars. And said party of the second part covenants that he will use said property for the purpose of carrying on said Ferry and Transfer business across the Missouri river, between Sioux City, Iowa, and Covington, Nebraska, and at said points that he will use all due care and diligence in guarding said property from all damage, and keep the same in as good repair and condition as the same now are, or may at any time be placed in by said first party; damage by superior forces, inevitable necessity, or fire from any cause than from the carelessness of the lessee or persons of his employ only excepted. That at the expiration of this lease, or upon a breach by said lessee, of any of the covenants herein contained, the said second party will, without further notice of any kind, quit and surrender the possession and occupancy of said property in as good condition as reasonable use, natural wear and decay thereof will permit; damage by fire afgre (Signed.)
