Excerpt: ...to form a belief that said personal property was or 'is the property of the plaintiff, or by reason of the detention alleged in the complaint, or of any act of the said Sheriff, the plaintiff has sustained any damage. FIFTH. And, further answering, these defendants aver that on the 21st day of March, 1879, Horace K. Thurber, Francis B. Thurber and Abner D. Thurber, as copartners under the firm name of H. K. & F. B. Thurber & Co., brought an action in this Court against "John" Hazen and " Richard" Compton, doing business in Valparaiso, Chili, in South America, as copartners under the firm name of Hazen & Compton, &c., to recover the sum of one thousand and twenty-three %U dollars, and interest from the 25th day of June, 1877, the balance of an account for goods sold and delivered by said plaintiffs to said defendants, and issued to the Sheriff of the City and County of New York a summons, and on the same day made application to Hon. Abraham R. Lawrence, one of the Justices of said Court, for a warrant of attachment against the property of said Hazen & Compton, and presented to the said Justice on said application, affidavits whereby it appeared that a cause of action against said Hazen &Compton existed in favor of said H. K. & F. B. Thurber & Co., specifying the amount of said claim and the grounds thereof, and that the defendants were not residents of the State of New York but resided in Valparaiso, Chili, in South America, and that a summons had been issued; and, at the same time, presented to the said Justice the undertaking required by law.
