That on the 2d day of June, 1899, the relator made and entered into a contract with the City of New York by its Commissioners of Parks, wherein and whereby the relator agreed to furnish and provide 15 all the necessary materials and labor required for the removal of the t2d Street Reservoir and other work in the 19th Ward of the City of New York, in accordance with specifications mentioned and annexed to said contract and plan or plans therein mentioned. That in and by said contract it was, among other things, provided as follows: "5. Whenever the word 'Architects' is used in said specifications or in this contract, it refers to and designates Messrs. Carrere & Hastings." That in and by said contract it was, among other things, further provided, as follows: 16 "B). To prevent all disputes and litigation, it is further agreed, by and between the parties to this contract, that the architects appointed by the Commisioners of Parks in charge of the work shall, in all cases, determine the amount or the quantity of the work which is to be paid for under this contract, and they shall determine all questions in relation to said work, and they shall in all cases decide every question which may arise relative to the execution of this contract on the part of the said contractor, and their estimate and decision shall be final and conclusive upon said contractor; and such estimate and decision, in case any question shall 17 arise, shall be a condition precedent to the right of the party of the second part to receive any money under this agreement."
