Percy, the Referee, dated September 8th, 1898, the amended complaint thereto unnexed, the report of the Referee, dated September6th, 1898, and the opinion of the Referee also annexed, and after hearing W. J. Woods, Esq., in behalf of said motion and no one appearing in opposition thereto, it is Ordered, that the defendant Edgar D. Thornburgh be, and he hereby is granted an extra allowance of five per cent, on $5,000, the amount go sued for in the amended complaint herein. And it is further ordered, that the Clerk of this Court be, and he hereby is directed to tax and enter the same in the judgment for costs to be entered herein, on the report of the Referee, Welton C. Percy, filed the 8th day of September, 1898. Enter. H. A. G., J. Judgment of the 22nd day of September, 1898. Upon filing the report of Hon. Welton C. Percy, Referee, duly appointed in the above entitled action, dated September 6th, 1898, and filed September 8th, 1898, and on motion of Ellis B. Southworth, attorney for defendant, Edgar D. Thornburgh, it is Adjudged, that the complaint herein be dismissed gg on the merits, and that the defendant, Edgar D.
