Except as hereinbefore provided in the caso of right of purehase covenanted in a lease, no agrcemi nt for the sale, lease, or other dealing with any estate or interest in land under the operation of this Act to be performed in future, shall be entered in the register beok; but any person elaiming an estate or interest in any such land under any contract or agrcement in writing or by transmission, may, hy caveat in the form of the Schedule hercto marked P, or as near thercto aa cireumstances will permit, forbid the registration of any instrument affecting such land, estate, or interest. Notice of caveat to parties. Person Mgtnjr caveat may be summoned to show causa. 97. Upon receipt of any caveat, the Registrar-General shall enter the particulars thereof in the register book, and also, if the e'me be preduced to him for that purpose, on the grant, certificate of title, lease, or other instrument evidencing title to the estate or interest affected by such caveat, and if such Srant or other instrument, as aforesaid, be not produced to him, then the egistrar-General shall give notice of the receipt of such caveat to the person registered as proprictor in respect to tlio estate or interest referred to in such caveat, and to every person presenting for the purpose of registration any instrument relating to Bucta estate or interest. and such registered proprictor, or ftny porson elaiming estate or interest in the same land. may, if he think 6t, summon the person signing such caveat to attend before tlie Judges of the Supremo Court of the said Province, or one of them. to shew cause rrhy such caveat should not be withdrawn; and it shall be lawful...
