On the nineteenth day of July, 1916, the said infor-mation, proceeding or complaint was called for hearing before me in the presence of both parties, whereupon counsel for the defendant (respondent) raised the question of law herein set forth and contended that there was no legal right to proceed further with the case. After hearing counsel for both parties on this point it was agreed by counsel that my decision on this question of law 50 raised and argued might be reserved to be given by me at a later date and in the meantime that the evidence should be taken and the merits gone into, all subject however, to the validity of the objection on this question of law so raised by counsel for the respondent. Vi/ith this understanding the evidence was taken and the merits gone into, all subject to such objection and question of law and my decision thereon. I then fixed Monday, the 24th day of July, 1916, at the hour of 10 o'clock as the time when my decision would be announced. On that date I gave judgment or made a determination of the question of law so raised. My judgment or ' determination was that the objection so raised was a valid ob jection and that consequently I had no jurisdiction or validity to give judgment on the merits of this case.
