Excerpt: ...Title Insurance and Trust Company and The Greenwich Savings Rank entered into an agreement in writing, dated the same day and duly executed, wherein and whereby it was agreed, among other things, that the ownership of the defendant, The Greenwich Savings Lank, in said bond and mortgage was to the extent of One hundred and seventy thousand dollar, with interest; that the Lawyers' Title Insurance and Trust Company was the owner of the balance of the said mortgage debt, subject to the interest of Municipal Realty Corporation under the agree 60 ment hereinbefore referred to between said Municipal Realty Corporation and said Lawyers' Realty Company; and that the ownership of said defendant, The Greenwich Savings Rank, was in every way prior in lien Id that of the defendant Lawyers' Title Insurance and Trust Company. XIII. That (be defendants have failed to comply with the conditions of said bond and mortgage by omitting to pay the principal sum of Two hundred and twenty-five thousand dollars, which liecame due on February 20, 1908: and that there is now justly due aud owing upon the said bond and " mortgage the said sum of Two hundred and twentyfive thousand dollars, together with interest thereon from the 1st day of August, 1907, at the rate of four and one-half per cent, per annum. XIV. That no other action or proceeding has been had at law or otherwise for the recovery of said sum secured by said bond and mortgage, or any part thereof. XV.
