Excerpt: ...was refused to the applicant and the license for the previous year was extended to the 1st of August then next, of which special meeting no notice had been published, and no proof on oath of any special grounds why the license should issue had been shown and the commissioners had refused to hear evidence in proof of objections to the license being granted is a license issued contrary to the provisions of the act, and should be revoked on an application to a judge under section 31. This was an application made to His Honor Mr. Justice Gregory, under section 31 of the Liquor License act, 1896, to revoke wholesale liquor licenses granted to the defendants at a special meeting of the commissioners held under sec. 7, sub-sec. 3 of the act, on the ground that the licenses were obtained by fraud and were issued contrary to the provisions of the act. His honor submitted for the opinion of the court the following case, viz.: 1. The defendant in 1900 applied for and obtained from the commissioners an order for a tavern license for his premises; before the license was issued the supreme court granted a prohibition to the commissioners against issuing the license. The defendant was then keeping a place for the retail sale of liquor as a tavern. On the prohibition issuing the defendant applied for and the commissioners granted him a wholesale license for the same premises for which the tavern license was to have issued. This wholesale license was renewed from year to year, and the one last issued from the 1st of August last is current, and this application is for the cancellation of this license. 2.
