Excerpt: ...said attorney conmiunicate with the said state auditor was to secure prompt action on the part of said Clark in the payment of the moneys so due him; that he believed that inasmuch as said Clark was in the employ of the said state, and as a subordinate of the said state auditor, the said state auditor would employ his friendly oflices in impelling the said Clark to pay to the afliant the moneys due him as aforesaid, but that afli-ant did not expect to be paid for his services out of the state treasury. Further afliant saith not. Jamrrs SINCLAIR. Subscribed and sworn to before me this 12th day of March, A. D. 1894. T. J. WHEELER, Notary Public, Ramsey Co, Minn. Also from testimony of Mr. Sinclair, given under oath before this committee, as to these appraisals alleged to have been signed by him in blank at the instance of Mr. Clark, and afterwards filled out by Clark to suit his own purposes, which estimates now appear in the files of the auditor's office. (See whole of book 23 of testimony.) The extract given below is a part of pages 24 to 33: Q. Now, you made an aflidavit as to this matter on the 12th day of March, 1894? A. Yes, sir. Q. In that aflidavit you made a statement as to the northeast quarter, the northwest quarter, the southeast quarter and the southwest quarter of 36-42-25? A. Yes, sir. Q. Have you ever estimated, at any time, the timber on that section? A. No, sir. Q. Never estimated it yourself, nor did you assist anybody in making an estimate? A. No. sir. Q.
