Clifford, Esq., Mohall, N. D. Dear Sir: We are in receipt of your letter of June 5th. In answer your first question, I think that section 2319, if it had never been touched by the legislatiure, would have required that an election of one of the commisioners of Renville county be had this year. But Section 2319 is expressly repealed by chapter 59 of the Laws of 1907, and the only section governing the term of commissioners is section 2390, which applies only to counties having five commissioners. Answering your second question, in my opinion section 5, chapter 63, of the Laws of 1907, does not govern the election of commissioners in substantially the same manner as section 2319 would have done if it had not been repealed. Chapter 63, Laws. of 1907, applies only to counties that are organized out of unor-' gani_zed territory. In counties organized in this way, the gov ernor appoints the county commissioners and all the county ofii-. cers, also designates the location of the temporary county seat.
