I will say that chapter 10 of the school law, 1897, gives full instructions to the county superintendent regarding the distribution and expenditure of the State school funds and the county school funds received by his particular county. After setting aside for certain specific purposes, as enumerated in section 1 of said chapter, so much of the county fund as the county commissioners shall order, the county superintendent is instructed to apportion the remainder of the county fund and all of the State fund received by his county to the several school districts therein; and then the last proviso of section 1 of the above mentioned chapter plainly states what use the districts are to make of this apportioned money received by them, namely: "that no part of either of said funds shall be used otherwise than for the payment of teachers, except as otherwise provided in this section/' This then fully establishes the only legal use of the State and county fund. It is the purpose and intent of the law that whenever a tax is levied, the pioney derived from such levy shall be used only for the specific purpose for which it was levied and collected. Section 1 of chapter 6 of the school law, empowers the board of school trustees to "annually order to be raised on the taxable property of the district, one-half of one per cent, for the siipDort of schools and to defray current expenses.'7 The phrase, "for the support of schools," comprehends also in its meaning that the teachers may be paid with the moneys derived from such a levy made by the trustees, and if in addition to this, outside of the State and county fund, more funds are needed for the payment of teachers, further provision for levying a special tax for this purpose is...show more
