Instead of the mere promise of workmen's compensation this plan might be so framed as to substantially assure to the employee the fulfillment of the obligation desired. Whichever version of this proposed scheme be followed it will be necessary to define the terms of the proposed workmen's compensation obligation, and here again the task is not easy. The important question will be as to the amount of the compensation. Other questions will arise as to the scope of the act; shall we try it at first as applied to dangerous industries only or to all industries or to all cases where the relation of employer and employee exists where the remuneration of the employee is less than a given sum; is the relief to be payable in a lump sum or in installments; what is to be the procedure, judicial or administrative, summary or otherwise; should the contingent fee be so limited in connection with the new procedure as to prevent abuse and bring it subject to the direction and control of the administrative power; shall there be any restriction upon freedom of contract as between the employer and his insurer; shall the employer's rights against his insurer be available to the employee; all these questions will arise and must be carefully considered from every point of view. And, finally, if this State shall work out a system of workmen's compensation along the lines hereinbefore indicated or in some other way, is it justified with due regard to the industries of the State in initiating such a system without the practically simultaneous adoption of a similar system by the adjacent and other States of the nation?
