This is all apparent to the most superficial observer at a glance. The new classification of provisions in the present Code of Civil Procedure, does not, in terms at least, embrace a considerable portion of the old Code, so that more than one third of that statute is presumed to be still in force, as well as large portions of the prior systems of practice in law and equity. Moreover many of the alterations made in the present Code have a direct reference to, and a necessary connection with, other changes contemplated and proposed in the remaining chapters and are therefore incomplete and often absurd or ineffective in their present mutilated condition. It is then indispensable to the proper and harmonious operation of the present Code that the remaining chapters should be adopted without delay. And this Association can render no greater service to the cause of legal reform and the welfare of society, than to press this measure with all its energy and power upon the Legislature and executive, until it shall become a law. Let us at least in this generation, have one system of procedure, complete and consistent with itself, whether it be defective or not in some of its minor details. Such defects will soon be remedied by the suggestions of experience. I do not mean to intimate an unqualified approval of the course pursued by the Commission, nor of its execution of the details of revision as contained in the fragment now in force. Many grave errors might doubtless be pointed out in these respects, but all of them are unimportant in comparison with the great and glaring evils of the mighty maze without more
