Excerpt: ...his appointment give a bond, with sureties to be approved by the appointing power, for the faithful performance of the duties of his oflice and for.the safety of the local standards and such appliances for verification as are committed to his charge and for the surrender thereof immediately to his successor in oflice or to the person appointed by the proper authority to receive them. 15. City Sealer: There shall be a City Sealer of Weights and Measures to be appointed by the mayor with the approval of. the Common Council of each city. He shall be paid a salary to be fixed and determined by the Board or body authorized to determine salaries of city oflicials, and no fees shall be charged or received by him or by the city for the inspection or testing of weights, measures or weighing or measuring devices. He shall perform in his city the duties of and have like powers as a County Sealer in a County. This section shall not apply to the City of New York." Section 15 has been renumbered and is now section 14. Under the old law the powers and duties of the County Sealer were confined to those towns where there was no Town Sealer and he manifestly had no authority in a city. Under the amended law, section 13, he has "power within his County," instead of being limited to towns as before. The City of Glens Falls is a part of the County and must therefore come under his jurisdiction unless the words "where not otherwise provided by law" (amended Sec. 13) taken in connection with new section 14, prevent this construction. In my opinion the provision for the appointment of a City Sealer is not such a provision that it will take away any of the authority of the County Sealer.
