The rolls not being numbered as r the office, and two days' notice must be given to the opposite attorney of the time when the costs are to be taxed; in other cases one day is sufficient. No rule in this court to be present at taxing is necessary. Affidavit of increased Costs. In the Exchequer. plaintiff, Between & defendant, J. T. of &c. for the above-named plaintiff in this cause, and R. F. of &c. the plaintiff in this cause, severally make oath and say; and first this deponent J. T. for himself saith, that notice of trial having been given in this cause for the last assizes, held in and for the said county of..., he caused two subpoenas for witnesses to be issued out of this honorable court, on the behalf of the above-named plaintiff, and copies thereof to be served on A. B. of, C, D. of, E. F. of, G. H. of, and I. K. of;and that one shilling was given to each of them for conduct money at the time of such service; and that the places of residence of the said A. B. and C. D. are distant from this deponent's residence ten miles, and from the town of, twenty-two miles; of the said E. F. and G. H., eight miles from this deponent's residence, and twenty-eight miles from aforesaid; and of the said I. K. fourteen miles from this deponent's residence, and twentyfour miles from. aforesaid; and that his brief consisted of brief sheets; and that he caused two fair copies thereof, to be made for counsel; and that he paid to Mr.., with his brief, guineas; and to Mr.------, with his brief, guineas; and to each of their clerks 2s. 6d.; and that this deponent attended at the said assizes, with his clerk; and that they were both necessarily absent on the trial of the said cause, in...show more
