J., Sept. 19, 19o4.--At May sessions, 1903, the grand jury returned a bill of indictment, being No. 27 of said term, charging the defendant, Samuel Dotterer, in the first count with rape; in the second count with rape; in the third count with assault and battery with intent to commit rape; in the fourth count with assault and battery with intent to commit rape; and in the fifth count with assault and battery. july 12, 1902, was laid in the bill as the date of the offense. He Commonwealth v. Dotterer. was duly tried upon said bill and the jury rendered "a verdict of guilty of fornication only and not guilty as to the other charges in the indictment." Sentence was imposed by the court on the same day. At May sessions, 1904, the grand jury returned as "a true bill" an indictment, being No. 15 of said term, charging the defendant, Samuel Dotterer, with fornication and bastardy. The date of the offense laid in this bill was also July 12, 1902. To this bill the defendant entered the pleas of "auter fois convict" and "not guilty." The district-attorney joined issue upon both pleas, alleging in answer to the first plea that there was no former conviction of the offense charged in this bill of indictment.
