Excerpt: ...in this behalf, the said plaintiff prays judgment, and his if in asaumpait, nay, damages by reason of the not performing of the said several promises and undertakings in the said declaration mentioned, to be adjudged to him, &c. If the action be debt, nay, debt aforesaid, together with his damages by him sustained on occasion of the detention thereof, to be adjudged to him, &c. If in covenant, my, damages by him sustained, on occasion of the said breach of covenant in the said declaration mentioned, to be adjudged to him, &c. If in trespass, sag/, damages by him sustained on occasion of the committing of the said trespasses or, in case, grievances, to be adjudged to him, &c. And the said plaintiff, according to the form of the statute in such case made and provided, states and shows to the court here, the following causes of demurrer to the said second plea, that is to say: for that. 850. here set out the causes of demurrer, according to the case; thus, for not concluding to the amntry, for that the said defendant hath not concluded his said plea. by putting himself upon the country, 850. Or, for pleading nil debet in debt on bond, for that although the said plaintiff, in his declaration, hath demanded of and from the said defendant, a sum certain due to him, the said plaintiff, from the said defendant, by virtue of a writing obli gatory under his seal; yet the said defendant hath not, in or by his plea, denied V the said writing obligatory to be his deed, nor in any manner shown himself to be discharged therefrom, and also for that the said defendant should have pleaded that the said writing obligatory was not his deed, and not that he did not owe the debt demanded.
