Excerpt: ...claimed; that plaintiff voluntarily went between the cars of said train while the same were in motion; that the plaintiff elected to go between said cars in violation of a rule of said company prohibiting employees from going between cars in motion to couple or uncouple them or for any other purpose whatever; that plaintifi is solely to blame for the accident ensuing from his ovn neglect and default and his consequent injury or injuries. Replying to the answer of the defendant the plaintiff says that he denies all statements contained in the answer except those admitted to be true by his amended petition, the substance of which we have heretofore stated, and plaintiff, for further reply, says that any written rule which the company may have had on said first day of March, 1911, prohibiting employees from going between cars in motion to couple or uncouple them or for any other purpose, was not, by said company, enforced, and that it was on said first day of March, and for a long time prior thereto had been, the general custom of the brakemen employed by said company when, for any reasonthe automatic couplers would not work, to go between the cars of said company and couple or uncouple the same with their hands, which practice was well known to said company or had existed for such a length of time that it should have been known to said company. It is by these pleadings filed by the plaintiff and the defendant, the substance of which we have stated, that the issues of fact between these parties are made up for your determination.
