E. M, one of the children, after her marriage became insane and incapable of making a will. A certificate as to the insanity was granted by the Commissioners of Lunacy in England, where she and her husband resided. Held, that the interest of E. M. in the estate 'was vested and would not revert to the estate in case of her dying without appointment; Also, that it was not subject to the Married Voman's Property Act of this province;. Also, that M., the husband of E. M., was entitled to receive and reduce into possession his wife's share, subject to a settlement. This was a special case submitted under the Judicature Act for the opinion of the court. John Tobin by his last will devised all his real and personal estate to his executors in trust to sell the same and collect and get in all moneys due and owing to him at the time of his decease. After paying all just debts and legacies the executors were directed to dispose of the residue, (among other provisions, ) as follows: " To invest the remainder of all the moneys derived from the sale of all my real and personal estate in good and sufficient securities either of real estate, British or Colonial bonds, city of Halifax debentures, or the stocks of the local chartered banks of the city of Halifax, as to them may seem best.
