Not illustrated. 1869 edition. Excerpt: ...submitted, T. D. PELTON, Counsel for Plfflf and App'z'. This action was commenced by the service of the summons and complaint, August 15th, 1866. The complaint alleges that the defendant sold and assigned to the plaintiff a judgment in favor of defendant, against one Blanchard and others, and covenanted with the plaintiff that he had not released either of said judgment debtors. It further alleges, that previous to said sale the defendant had released said Blanchard from said judgment; and that the plaintiff had incurred expense in endeavoring to collect said judgment from said Blanchard previous to ascertaining such release. The answer denies the sale of said judgment to the plaintiff, and the release of said Blanchard. Issue was joined October 13th, 18.6, by service of answer. The cause was tried on the 29th and 30th of April, 1868, before the Hon. Noah Davis, Justice, and a jury. The Judge directed judgment for plaintiff for $941.74, and costs. Judgment was entered July 14th,186S, for $1,166.44, The defendant appealed to the General Term, July 23d, 1868. You are hereby summoned and required to answer the complaint in this action, of which a. copy is herewith served upon you, and to serve a copy of your answer to the said complaint on the subscriber, at his oflice, No. 44 Wall street, New York City, within twenty days after the service of this summons on you, exclusive of the day of such service; and if you fail to answer the said complaint within the time aforesaid, the plaintiff in this action will apply to the Court for the relief demanded in the said complaint.
