" 3dly. I am further of opinion fthat the right of jurisdiction over the land above mentioned, under the water of Hudson's River, is vested in the Corporation: First, Because their charter extends the city to the west shore of Hudson's River, or to the west bounds of the Colony of New York; and Secondly, Because of the County of New York, according to the act of the Legislature dividing the state into counties, is bounded by the State of New Jersey to the westward or the west side of Hudson's River. " 4thly. In answer to the fourth question, I beg leave to say that I incline to the opinion that no wharves can lawfully be built on the west side of Hudson's River, opposite to Powles Hook, unless by permission, and under the direction of the Corporation; nor at any rate, without a grant from the state for the land to be covered by them." Relying on the correctness of these opinions, the Common Council of New York on June 4th, 1804, issued the following warning: " The Board having been informed that sundry persons have lately undertaken to construct wharves within the bounds of this City between high and low water mark, on the west side of Hudson's River, without any authotity for so doing from the people of the State of New York, or from this Board, Do hereby give Public Notice, that such encroachments being made without their permission or consent must be at the peril of the persons concerned."
