There were two reasons for not asking for n re money at that time, first in order to lessen objections to 1 ii.ssage of the law from the financial argument, and second, that it perhaps would not be advisable to unduly rush proceedings under the new law, as, notwithstanding its many years trial in Wyoming, it might not be found to be entirely applicable to conditions in Oregon. No serious defects have so far appeared, and after nearly two years' trial, it is apparent to the practical man who has made any study of the law, that it is entirely suited to con ditions in Oregon. This law is necessary for the protection of rights heretofore initiated when these are determined. It is necessary that these rights be determined so that the amount of unappropriated waters remaining in our streams may be ascertained and made known to the public, also as a basis for the protection of stored water as it is conveyed in the natural stream channel to the place of use. A method of legally and definitely initiating rights to surplus water as therein provided, is necessary for the encouragement of capital to invest in irrigation and other works, and such investments are necessary as a basis for all classes of development in the arid portion of our State.
