Imbeciles are out of harmony with their vital environment; idiots with their physical environment. Commitment to Asylnms. Insanity boards, or lunacy commissions, are organized for the investigation of a person's mental condition with a view to his incarceration in an asylum, if found to be of unsound mind. The chief object of this investigation and incarceration ' is the protection o'f the lunatic and others from his insane fury, or liability to perpetrate violent injuries; and therefore the insanity board must not only find the accused to be insane, but also that he ought to be committed to the asylum. There must be something more than mere inability to manage one's estate to justify restraint upon his personal liberty. There should be a finding that the person in question is a menace to the life and security of either himself, or others, or both; for so long as one can conduct himself consistently with personal safety to himself and others, and will likely do so according to the prognosis of his ailment, it is very doubtful about any board having power to deprive him of his freedom and immure him in an asylum. Validity of Wills. Less mental capacity is essential for the execution of a valid will than for the making of a contract or the forming of a criminal intent. The courts have uniformly shown more favor to the wills of imbeciles than to their agreements. Incapacity is not merely weak capacity; it is a total lack of a disposing mind and memory.
