A bond given by a contractor to build a public schoolhouse, which is simply conditioned for the faithful, timely, and trueperformance of the "contract, plans, and specifications to which reference is hereby made, and made a part of the bond," where the contract, even if conceded to be part of the bond, merely provides that the contractor shall furnish the labor and materials, without binding him to pay for them, will not support an action by ar unpaid materialman. A bond made by a contractor to secure a county from loss in the performance of a building contract for a public work, simply conditioned against liens upon such work, chargeable to the county, and providing for the payment thereof, imposes no liability on the surety in favor of materialmen whose claims are not chargeable to the county, when there is a statute by which a laborer or a materialman may have, in certain circumstances, a claim against a public corporation for labor don that in fidelity insurance, which is of recent origin, notice of the fraudulent acts of the employee is of equal, if not greater, importance referring to notice of loss in fire insurance cases, for the reason that prompt notification may often enable the insurer to avoid or secure indemnity for losses which otherwise would be inevitable or irremediable,"--citing Riddlesbarger v. Hartford F. Ins.
