Excerpt: ...behalf of the charity, and directed that the fund in court, when paid out to the official trustee of charity funds, should be applied in or towards the proposed purchase, the trustees of the charity petitioned for the transfer of the fund in court to the official trustees, and that the costs including the costs of re-inveatment might be paid by the corporation. Held, that the transfer to the official trustee was payment to a person absolutely entitled, and the corporation were not liable to pay any further costs: iRe Bishop Monk's Horjield Trust. MalinB, V.C. Jan. 28.) Woman past Child-hearing--Widow aged Fifty-two--Payment by Trustees.--By a settlement on the marriage of C. Taylor in 1849, personal property was assigned on trust during the joint lives of herself and her husband for her separate use, without power of anticipation, with remainder to tho survivor for life, with remainder to the children of the marriage as she and her husband should jointly appoint, and in default of appointment, to all the children of C. Taylor by that or any other marriage equally at twenty-one. The husband died in 1856. There was one child only of the marriage, who attained twenty-one and died. The widow took out letters of administration to his estate, and being aged fifty-two, applied to the trustees to pay over tho trust fund.
