Stephenson v. Garnett (78 L. T. Rep. 371; (1898) l Q. B. 677) was cited. The covenant in the marriage settlement by the wifc was that she would assure and transfer " all real and personal property " to which she should become entitled at any time during the cove-rture, excepting jewels, &c., and legacies or other property not exceeding 100, " whether in possession, reversion. or otherwise," to the trustees of the settlement upon trust to sell and convert any such property not consisting of money or not being invested in certain authorised securities and to stand possessed of the same upon trust to pay the income thereof to the husband for his life, and then to the wife for her life, with remainders...show more
