Sheriff Birnie, Hamilton, tried to enlighten the trustee of the Wishaw estate on this point. The said trustee summoned a miner for having "poached" on the lands 11I1(l8I' his care, in that he shot two wood pigeons. Defendant, seemingly conscious of rectitude, made no attempt to hide the birds when accosted by the gamekeeper, nor was he known as a poacher. The learned sherifl' ruled that inasmuch as wood pigeons were not " game," the charge could not be" sustained. The prosecutor evidently has a higher opinion of the wood pigeon, for he notified his intention to appeal to the High Court. If our reading of the Game Acts is correct, wood pigeons are not game. Perhaps the Scottish law is diflferent. Mr. Snow also draws attention to the disastrous delay which nearly always occurs between the hearing in the Court of Appeal and the decision in the House of Lords: ---"In Derry v. Peek the Court of Appeal gave judgment within a year from the decision of Mr. Justice Stirling. But it took one year and eight months before the case came for final decision before the House of Lords. So in Vagliano v. The Bank qf England, an interval of two years elapsed before the House of Lords revised (March, 1891) the judgment of the Court of Appeal (March, 1889)."
