Excerpt: the court of common pleas, Pittsburgh, Pa., May 11th, which aims to put in question the constitutionality of that provision of the Pennsylvania cold storage law which places a limit to the cold storage period and forbids the sale of foods stored beyond said limits, regardless of their qualit_v. The suit is brought by E. S. Nolan, a wholesale butter and egg merchant, against E. P. Jones and Jennie Jamieson, special agents of the dairy and food division of the state department of agriculture, and Commissioner James Foust. The Union Storage Co. is made a party to the suit, because the goods in question were held in said company's cold storage warehouse, were there seized and are there being held by said defendants. A permanent injunction against the defendants and for release of the goods is prayed for. The goods in question are three tubs of butter. the remnant of 78 tubs of butter placed by plaintiff in June, 1915, for storage in the Union Storage Co.'s warehouse. The law forbids holding foods in cold storage more than nine months. At the end of the nine months period all but three tubs of the butter had been withdrawn and these three tubs were promptly seized by the defendants and marked with tags "Not salable for food under Penalty of the Lav. Not wholesome, unfit for use as food," etc. The plaintifi avers that the seized butter is perfectly wholesome and of good quality, that he has no cold storage room of his own to hold said butter, that he suffers irreparable injury by the labelling of his pure wholesome product as unfit, and, moreover, that the act, in so far as it prohibits the sale or ottering for sale of foods held in cold storage for longer periods of time than those specified in Section 16 of said act, is...
