Should there be any surplus "after the above expenditure, then I do hereby direct my trustee to spend " the said surplus in the contribution towards the marriage of the daughters " of the poor in my class and of the poor Brahmins, and towards the edum" tion of the sons of the poor amongst my class, and of the poor Br-ahmius, "and other respectable castes, as my trustee will think fit to comply." Held, that the gifts were valid testamentary bequests, and that the words " should there be any surplus after the above expenditure," created a general residnary bequest. Held, on appeal (affirming the decision of the Court below), that a general residuary bequest was created by the concluding words of the clause, which would absorb any of the preceding bequests, if they should happen to be invalid. Quzzre.-Whether the bequests to pundits holding tolls, and for the reading of the Mohabharat and Pooran and for prayer t0 God, were valid 2 APPEAL from a decision of Pontifex, J., dated the 16th of January 1878. This was a suit for (among other things) the construction of the will of one Kristomohun Bysack, who died on the 19th of April 1870. The testator, by his will, after leaving asum of Rs. 2,000 for enabling his executor to perform "my funeral rites and ceremonies after my demise, and to perform the srad/r and other ceremonies for the benefit of my soul," and after making provision for certain family idols, and making certain small private bequests, provided by the last clauses of his will as follows: "I do hereby direct my trustee to feed the really needy and poor at Gopeenathjee out of a separate...show more
