Excerpt: ...The grounds of the judgment were the following: ---Though municipalities cannot grant a monopoly of private lighting to any one, it belongs to them to secure a service of lighting within their district, both public and private, and they must not authorize or favour any competition with their concessionary. In this case the municipality had conferred a monopoly of the use of the town streets or ways, and in return considerable advantages had been secured by the town. The town had itself recognised that it could not favour any new lighting company. It had therefore mistaken its rights in grantinga concession to the electric company, and must pay damages, to be afterwards ascertained, to the gas com pany, with costs. In the second of the two cases, that of St. Etienne, the gas company was under obligation to adopt any new system of lighting which might come to generally replace gas; and therefore the gas company, being under that obligation, had a right in electric lighting, and the municipality, having authorized the electric company to use the streets, must pay the gas company damages, to be ascertained, with costs. Tm-: Paris Town Council appears to be in great trouble over its Halles Centrales electric-lighting station. The light is going out frequently: the consumers are excited and wrothful: the Electric Lighting Committee wants to buy accumulators, and is, at the same time, called upon to diminish its outlay by 1,240 a year; and its engineers are unwilling to work in a hot corner without ventilation, and are found either falling into ill health or accepting service under electric companies as soon as they possibly can.
