Excerpt: ...procured such consent to lay tracks along the Southern Westchester Turnpike referred to in the complaint, but these defendants deny, upon information and belief, that The' VVil1iamsbridge and VVestchester Traction Company and The Wakefield and Westchester Traction Company have procured such consent to lay tracks, in whole or any part, along any portion of the highways mentioned in the complaint, upon which, when this action was begun, the plaintifi had, as alleged in its complaint, begun to construct a railroad; and these defendants deny, upon information and belief, that plaintiff was lawfully or exclusively entitled to lay tracks or operate the same along any part of the said highways under the special grant conferred by said Chapter 361 of the Laws of the State of New York of 1863 and its amendments. These defendants deny, upon information and belief, that the acts, or threatened acts of these defendants, as alleged by plaintiff, are contrary to law, or that they are in violation of plaintiff's rights or alleged rights. VIII.--Said defendants deny that they have any knowledge or information suflicient to form a belief as to whether, on the 7th day of J une, 1892, upon the hearing of the application before said Town Board for said consents by said Traction Companies, these defendants, the plaintiff appeared and formally protested against the granting of said consents upon the grounds that said consents, if granted, would conflict with the plaintilf's rights, privileges and franchises as aforesaid, and with the law of the State of New York.
