Application for pol: lcy--The pla1nt1iT's mother applied to the'def_endant company for a $1.000 policy of hfe insurance. Soon after her application she pan! the first premium and obtained a receipt from the compau_v's agent. Her application was approved by the defendant. and a pohcy of msurance for $1,000. to which was attached a_ copy of the application, was issued mailed to the defendant's agent, together with the oilicial receipt for the premium. The company at the same time called its agent's attention to the fact that there was a discrepancy b_e tween the age of the applicant as stated in her application and as given in the d_octor's report. The agent called at the apphcant'. home and learned from the plaintiff that her mother was one year older than she had stated in her application. The agent then informed the plaintilf that if the policy was to be for $1,000 there would have to be an additional premium paid. The plnintifi paid the additional amount and the agent returned the policy to the company's head ofiicc. A few days later he received' a new policy. bearing the same date. and similar in all other respects to the first policv, except that the premium was larger. When this policy was received the agent did not deliver it, as he had learned that the applicant was ill. A few days later she died.
