Excerpt: ...give ten days' notice under this provision in Rule III before the water to a consumer is shut off. and to reduce the penalty imposed from two dollars to one dollar. Respondent's Rule 13 provides that all bills will be made out in the name of the property owner and that in the event of a change in ownership of the property and any portion of the water rent.should remain unpaid, the water shall be turned off from such premises by the water company and service refused until such arrearages are paid. The question whether under the circumstances specified in this rule a water company may refuse to furnish service until arrearages of former owners are paid seems to persist in its recurrence from time to time. In Chace vs. Citizen's Water Company. I'. I'. R., 70S B, 1916, this Commission discussed at length the economic and ethical principle underlying such a rule or regulation of a public utility, and reached the conclusion that a rule imposing such restrictions should not be permitted to stand. The same ruling was made in Rochester B. and L. Association vs. BeaveiValley Water Company, 3 Pa. P. S. C. 120; 5 Pa. Corp. Rep. 590, affirmed by the Superior Court under the name of Beaver Valley Water Co. vs. Pub. Serv. Com., 70 Pa. Super. Ct. 621, and in other eases with respect to the payment of arrearages by subsequent occupants of premises. In the instance pending the Commission finds nothing in the provisions or fundamental principle of the rule to differentiate it from the rules and regulations upon this feature of the service which were ordered.stricken off from the tariff in the eases cited above.
