Excerpt: ...to extend, to all cases and places as aforesaid where there are no separate churchwardens or overseers of the poor. or where no separate or distinct rate is made. and collected for the relief of the poor of any such division. or part of an parish, township, or place, situated in and exten ing into two or more counties, ridings, or divisions as aforesaid, and that all and every the constables, churchwardens, and overseers of any such parishes, townships, hamlets, or other places, as are situated in and extend into two or more counties. ridings, or divisions, having separate and distinct commissions of the peace as aforesaid." Then there are certain fiuther provisions for giving effect to that. Well, it seems to me that the clause would apply, after the year 1856, to this newly constituted arish for the urposes of the county rate, alt ough, in the angua e of the Act, it is to be deemed to be altoget er in the parts of Holland, in the county of Lincoln, yet the proviso, as I have already said, appears to me, by implication, to reserve to the justices of the several divisions of Kesteven and Holland, their rating power, and to enable them to act accordingly. Sect. 3'3 provides what the overseers of the parishes situate partly without are to do; boroughs, of course, not being liable for the county rate; and sect. 33 must obviously be read in connection with sect. 32. Then we come to sect. 34. That provides. " That where a precept shall be issued to the uardians of the union comprising any such paris or place under the provisions in that respect hereinbefore contained, and such precept shall contain a sum to be assessed and charged in respect of any such rate as is herein provided for upon a part of such parish or place as...show more
