That the premises of the plaintiff and defendant are each worth upwards of thirty thousand dollars. CON OLUSION S OF LAW. I. That the plaintiffs land and the entire premises owned by said Miller at the corner of Madison avenue and Forty-third street, New York City, are subject to the covenants contained in said restriction agreement, and that each of them is bound to observe and perform the obligations thereof. II. That the covenants of said restriction agreement are binding upon the defendant The Taylor Company and it is bound to observe and perform the same. III. That the undertaking business, involving as it does the receipt of dead human bodies for temporary storage and for occasional autopsical or other postmortem examinations, and being offensive and injurious to the inhabitants in the neighborhood of The Taylor C0mpany's building, is a violation of the covenants contained in said restriction agreement. IV. That the use of said Taylor Company's premises for funeral purposes as a business being offensive and injurious to the neighboring inhabitants, is a violation of the covenants contained in said restriction agreement. V. That the use of any part of "said building by The Taylor Company as a dissectingfroom or for autopsical or other post-mortem examinations being offensive and injurious to the neighboring inhabitants, is a violation of the covenants contained in the said restriction agreement.
