No. 3 for identification of this date? A. I did. Q. Is that signed by him?. A. Yes, sir. Mr. Marvin: I offer that in evidence for the purpose of proving, first, a receipt by Mr. Scofield of Mr. De Graaf's endorsements on $20,000 paper, which it was represented by him were to be negotiated with Mr. Jacob F. Wyckoff, and for the purpose of showing that Mr. Ssofield agreed to place with this paper in Mr. Wyckoff's hands $40,000 of the first mortgage bonds of the Utah & Pleasant Valley R. R. Co. as security for the payment of those notes, and that the notes so to be secured were those for which the 918 notes described in the complaint were given in renewal. Mr. Butler: I object to the offer as immaterial, not pertinent to the issues under the pleadings, and as an incompetent mode of proving a fact which is not brought to the knowledge of this plaintiff; it is in the nature of collateral evidence. The Court: I don't think it is material. (Paper excluded and defendant excepted.) Q. Now, I will ask you whether the $20,000 notes made in October, 1879, were endorsed by you and mentioned in this Ex. 3, were delivered by you to Mr. Scofield? (Objected to for the same reason as the first objections.) The Court: You have proved it once; I have al-920 lowed you to prove it once. Q. And were those notes delivered to Mr. Wyckoff? A. I don't know; I delivered them to Mr. Scofield at my bank. Q. Now, I will now hand you Defts.' Ex.
