Excerpt: ...as follows, to wit: Beginning at the southwest corner of said Milton Knickerbocker's Wood Lot and runs thence north 88 degrees and 30 minutes west 8 chains 78 links; thence north 16 degrees east 10 chains; thence south 81 degrees east 7 chains and 53 links and thence south 16 degrees west 8 chains and 36 links to the place of beginning containing 7 acres and 5-10 of an acre of land. That the said mortgage contained the same conditions as the said bond, and in case of default in the payment of the said sum of money, or the interest that might grow due thereon, or of any part thereof, the said Sally E. Brockway was thereby 18 empowered to sell the said mortgaged premises according to law. That the said mortgage was duly recorded in the Clerk's office of the County of Rensselaer on the 12th day of May, 1870, in Book No. 124 of Mortgages on page 91, &c. That the said Sally E. Brockway thereafter died leaving a last Will and Testament of which the plaintiff was duly appointed the executrix by the Surrogate of the County of Rensselaer and letteis testamentary thereon weri on the 5th day of Jan nary. 1885, duly issued to the plaintiff, she 19 having duly qualified as such executrix and that the plaintiff is still acting as such. That the said defendants Martin Strever and Dorcas A. Strever, his wife, failed to comply with the conditions of the said bond and mortgage by omitting to pay the sum of four thousand ( 4,000.) which became due and payable on the first day of. May, 1882, and that there is now justly due to the plaintiff upon the said bond and mortgage the principal sum of four thousand dollars ( 4,000.) together with the interest thereon from the firstday of May, 1892, at the rate of live per cent. per annum, the rate...show more
