But this opinion feems deftitute of foundation, and is fuflieientlv refuted by the advice of the learned Mr. Yorke, His Majefly's Altor ney-general, who has advifed that the Canadians {hould be permitted to retain their ownlaws, relatingto Inherit ances and the Alienation of their real ettates, which would be impoflible without an act of Parliament for that purpofe, if the whole fyficm of the Laws of England did ipsofacto become the Law of the province upon its being conquered, or ceded to the Crown. Indeed, the whole fyttem of the Laws of England, taken in the grots, and without a feleetion, would be by no' means a blefling to the Canadians. The game-laws, the poor-laws, the fietions and fubtleties in various forts of e tions and conveyances, the niceties arifing from the doctrine of nfes, and the tedious and operofe inttru ments founded on them, would really be a great misfor tune to them 3 and, from their novelty and firangenefs, would be thought to be a much greater. This Doctrine therefore of the iuflant validity of the whole mafs of the Laws of England throughout the conquered province cannot be true. And if the whole fyfiem of thofe laws is not valid there, then certainly no part of them can he fo. For if they are, then who thalldiftinguilhwhich of them are valid there, and which are not?
