If the chemical individual has been known to exist as processes, or a product incidental to the known fabrication of and use of natural products, there is, of course, reasonable doubt as to its novelty. This is not so simple as it appears. A chemical individual of an homologous series not hitherto known to have been isolated, to have existed, or to have been described, but which might have been easily forecast by anyone possessing a detailed and intimate knowledge of the general properties of existing known individuals of the same series, could hardly be called new. Otherwise, thousands of compounds of carbon, hydrogen, oxygen, and nitrogen useful or useless, might be the basis of product patent. If product novelty is confined to chemical individuals not belonging to an homologous series, not stereo isomeric, and not found existent in nature or in natural products, then the field of invention of chemical individuals is rather limited; but compensation exists in the possibility of novelty in the method of production. About the second class of chemical invention there may be some ground for disputation. In that class it is logical to include all mixtures of chemical individuals. some of the individuals being essential to the process, the presence of others being due to the exigencies of commercial manufacture. In this class there may be existent new chemical compounds, possible or impossible of identification, isolation, and de a product of natural scription, such identification not being essential to the novelty of the invention.
