Excerpt: ...to a small newsboy, and while he was speaking to him he happened to glance around (fol. 263) and saw: "two ladies crossing the street with a boy slightly in advance of them, and the lady bad a child and seemed to have something in her arm like a package of some kind, and the lady who was following the lady with the baby in her arm had some packages in her arms, and then I turned to resume the conversation with the small boy, and just about--well, three minutes or two minutes, I should say, I heard a shout, and turning around, I seen the woman step back, and the child ran forward and then turned back and then ran forward and was struck by the horses and fell on the track and was run over." (fol. 264). On his cross-examination he said the plaintiff was between the rails of the westbound Twentythird street track when struck, and was running (fol. 267); he denied that he knew anyone connected with the defendant company (fol. 270); but finally admitted that he knew a man named Brown and President Vreeland and two or three others (fols. 271, 272, 275, 27fi); he denied that he had ever been a witness in a case in the Fifty-seventh street Municipal Court, and then admitted that he had been a witness for his mother in a case in that court, but he could not remember whether he had ever testitled in that court as a witness for the defendant, even saying: "I would not remember if I had" (fols. 270, 277). In the testimony of this witness on the directexamination we have a most remarkable recitation of details, especially with reference to the two women, whom the witness saw, as the result of a casual glance, all of which corresponds exactly with the various details given by the different witnesses for the plaintiff.
