A wrong draw-bar applied by a foreign company and carded for is replaced by an intermediate com-I pany and bill made upon card, which is refused by company which applied it, they claiming they were responsible only to the owners; but it was decided bill should be paid, as it was shown that the company which replaced the wrong draw-bar acted as agents for owners, as owners had refused to accept the car until the wrong draw-bar was replaced. (Obsolete after Sept. 1, 1893.) CASE 174, MAY, 1893. A company carding for broken draft springs objects to paying five cents per Ib. to the company replacing them; but as their card was issued previous to the adoption of the rule which excepts springs from the price established for steel, they should pay the bill charging five cents per lb. (See Case 133.) CASE 175, MAY, 1893. A company loses a defect card of another company and applies their own card in place thereof, noting upon it that it was to replace the foreign card. The owners of the car who issued the original card claim the duplicate did not read exactly the same as their card, and as the duplicate covered a defect which did not exist when they carded, render bill accordingly, and it was decided bill should be paid. ' CASE 176, MAY, 1893. A company charging for applying a sill per defect card includes labor preparing the. sill in addition to the amount allowed by rules, claiming the paragraph preceding the list of labor charges on sills. etc., permitted labor to be included in the material.
