That there is hereby established at Lineville, Clay County, Alabama, a school for teaching agriculture, and domestic economy to be known as the "North East Alabama Agricultural and Industrial Institute," etc. The school is organized so that its course of study embraces the entire elementary and secondary divisions. It serves the city of Lineville as a public school. It receives a good apportionment from the general school funds at the hands of the County Board of Education, and the City of Lineville makes an excellent appropriation for its support. The school is well organized as a combined elementary and high school of the standard type. The teachers are professionally trained, and are doing excellent service in the customary lines of elementary and secondary work. The school as a regular city school of the standard type is an excellent one. But, in my opinion, as conducted in 1916-17, it fails absolutely to carry out the spirit of the law which brought about its establishment and which provides $3,000.00 annually for its support, in that it is not a special school of agriculture and domestic economy. It is not believed that the legislature intended to appropriate $3,000.00 annually merely to help the city of Lineville maintain its public school system thereby discriminating against scores of other Alabama towns maintaining schools of the same character. I repeat, that in my opinion, the North East Alabama Agricultural and Industrial Institute at Lineville, as conducted at the present time, is not a special school of agriculture and domestic economy and consequently is not carrying out the provisions of the legislative enactment which provided $3,000 annually for its support.
