The breach of covenant was brought about by the threat of a strike, and it lies on the defendants to show justification for the interference which causes the breach. Lord Watson in Allen v. Flood 1898 A. C. 1, at p. 94, 67 L. J. Q. B. N. S. 119, 77 L. T. N. S. 717, 46 Week. Rep. 258, 17 Eng. Rul. Cas. 285, pointed out that "in any legal question, malice depends not upon evil motive which influenced the mind of the actor, but upon the illegal character of the act which he contemplated and committed." In this case the question is not of a superior right or of an act done in pursuance of some duty, and it was not a case of giving advice. There is nothing in the rule of the society which forbids the teaching of an adult, and that disposes of any legal ground of interference. They referred to I/umley v.
