GEN'rLEMEN: --I beg to acknowledge receipt of your coinmunication in which you ask for my ofiilcial opinion as to the General Opinions. validity of chapter 282 of the laws of 1901, and whether or not you should audit the accounts and disburse the moneys as therein-provided.-In reply beg to say, chapter 282 of the laws of 1901 makes an appropriation of $2l),000 from the general fund, for the purpose of constructing and strengthening the levee systenm already existing in the vicinity of Portage, on the Wisconsin river, in Columbia and Sank Counties. It then authorizes the Governor to appoint three commissioners to have charge of the work of constructing and strengthening the said levee system now in existence, in such manner as in theirijudgment will best protect said city and vicinity from the overfiow of the Wisconsin River, and further provides that they shall certify the bills which may be contracted for such work, and that such bills shall be approved' by the Governor and, when so approved, they shall be audited by the Secretary of State and warrants drawn therefor, to be paid by the State Treasurer out of the general fund. The title of the act declare's that it relates to the levee of the city of Portage and vicinity, and makes an appropriation therefor, for the purpose of protecting the lives and property of the citizens of the State of Visconsin.
