Guggenheimer, his attorney, respectfully shows to this Court, as follows: First.--That at a Special Term of this Court, held in and for the City and County of New York, on the 27th day of September, 1895, the said Henrietta Harris was duly appointed guardian ad litem of the said Harry B. Harris, an infant, for the purposes of bringing and prosecuting this action. Second.--That at all the times hereinafter mentioned the defendant was, and it still is, a domestic corporation, operating and running a line of cable cars along Third avenue and other streets and highways in the City of New York. Tliird.--That on or about the seventh day of September, 1895, the said Harry B. Harris was lawfully crossing Twenty-second street at the intersection of Third avenue, mounted on a bicycle. Fourth.--That between the hours of two and three in the afternoon on that day while the said Harry B. Harris was making his way across said Twenty-second street on said bicycle an approach ing cable car, belonging to tbe defendant and under the control and management of an employee of the said defendant, going at an unusual rate of speed, collided with and struck the said Harry B. Harris, inflicting upon him serious and permanent injury to different parts of his body, caused his left leg to be broken and otherwise severely injuring and braising the said Harry B. Harris, causing him to be roufined to his house where he still remains, and is likely to be confined for some time to come. That there has also been and will be expended 23 for him and on his behalf and account large sums of money for medicines and physicians for the purpose of effecting a cure of the aforesaid injuries, all to more
